General Terms & Conditions

<h2 class="wp-block-heading">Additional Terms &amp; Conditions for LEO</h2>

<ul>
<li>Customer is strictly prohibited from reselling LEO Services.</li>
<li>Customer and/or User are prohibited from installing or using the LEO hardware and/or LEO Services on a moving vehicle or vessel or aircraft.</li>
<li>Customer and User are not authorized to use Expereo Supplier’s name, trademarks, logos, designs and service marks in any way or for any purpose. If Customer or User fail to comply with this clause, this will result in a material breach.</li>
<li>Unused Business Priority data does not rollover to the next month. Users who have exhausted their Business Priority data in a given month, will be allocated an unlimited amount of Commercial data for the remainder of the month, which may result in slower speeds and reduced performance compared to the Business Priority data.</li>
<li>Customer agrees not to use, or permit others to use including Users, the Services in ways that (a) violate any law or applicable regulation, (b) violate this Agreement, including Expereo’s Supplier policies, which can be found on the website, (c) infringe the rights of others, (d) interfere with the users, LEO Services, or LEO hardware of the Expereo network or other networks, or (e) are outside the Permitted Use described in Section 1.1 of this Agreement. In the event of any violation of this Section, Expereo reserves the right to terminate or suspend LEO Services to the Customer or the User.</li>
<li>Expereo is not responsible for damage to the LEO hardware after delivery, or for Service malfunctions resulting from: (a) manual re-pointing of the antenna; (b) repair, modification, or disassembly of LEO hardware by anyone other than Expereo or its authorized agent; (c) failure to follow instructions, including by obstructing the LEO hardware’s field of view; (d) fire, flood, wind, lightning, earthquake, weather, or other acts of nature or God; (e) spills of food or liquids on LEO hardware; (f) problems with your electrical power or network equipment; (g) misuse, abuse, accident, vandalism, alteration, or neglect; (h) normal wear and tear or deterioration, or superficial defects, dents, or marks that do not impact performance of the LEO hardware; (i) use in combination with devices or software not provided or approved by Expereo; (j) inability to obtain or maintain necessary permissions, authorizations, or permits; or (k) events not reasonably within Expereo’s</li>
<li>Customer and Reseller are prohibited from artificially throttling LEO Services or otherwise degrading Users’ LEO Service experience for other reasons. Expereo reserves the right to audit such network management practices by Customer and Reseller and to terminate this Agreement and Services (after a 30-day notice and cure period) if it determines, at its sole discretion, that such practices are being abused.</li>
<li>The LEO hardware and LEO Services are under development, and subject to change. Expereo will use reasonable efforts to facilitate that the Expereo hardware, at the time of delivery, and the LEO Services, as performed, substantially meet the communicated performance goals. If Expereo releases an updated version of the LEO hardware, the updated version will be of a comparable performance to the LEO hardware purchased by Customer in the SOF.</li>
<li>Expereo provides the LEO hardware and the LEO Services “as is”, without any express warranty or representation. Expereo disclaims all implied warranties and representations, including any implied warranty of merchantability, fitness for particular purpose, and non-infringement.</li>
